I. The Provincial Agency for Sustainable Development modifies the regime applicable to the holders of PCBs in the Province of Buenos Aires
On November 9th, 2011, Resolution No. 189/2011 of the Provincial Agency for Sustainable Development was published in the Official Gazette of the Province of Buenos Aires.
This regulation modifies section 5 of the Resolution No. 1118/02 of the former provincial environmental agency. The new text of the section defines the following expressions: (i) “PCBs’ Free Fluid”: when the concentration of PCBs is equal to or below 0.0002% (or 2 ppm) determined according to the regulation ASTM D 4059 or an equivalent regulation; and (ii) “Elimination Plan”: a set of activities or processes tending to reduce the concentration of PCBs in closed systems to 0.0002% (or 2 ppm) or a lower quantity. The previous wording indicated that the concentration should be below 2 ppm only.
Section 7 of Resolution No. 1118/02 of the former provincial environmental agency is also modified, and the obligation for transport, distribution or electricity cooperative companies to execute agreements with the Provincial Agency is set forth, with the aim of adapting the decontamination schedule of equipments with polluted fluids.
II. The City of Buenos Aires sets the geographic area of the Matanza-Riachuelo River Basin in the city and declares emergency in said area
On November 22nd, 2011, Law No. 3,947 was published in the Official Gazette of the City of Buenos Aires. This law declares social, urban, environmental and sanitary emergency for a period of 5 years in the Matanza-Riachuelo River Basin in the City.
In addition, the regulation sets the area of the Matanza-Riachuelo Basin in the City of Buenos Aires to the geographic area conformed by communes 4, 7, 8 and 9 (according to Annex I of Law No. 1,777).
