Opening of Dumping Investigation

Within the course of one week, the Secretariat of Industry and Trade opened investigations regarding the alleged existence of dumping in exports of: (i) towels originated from Brazil; (ii) paper and cardboard originated from the United States of America, Korea, Finland, Austria and China; y (iii) spun glass originated from Mexico.

Resolution No. 234/2010 of the Secretariat of Industry and Trade, published on December 14 in the Official Gazzete was announced in connection with the investigation initiated by the alleged dumping in exports to Argentina of “towels, including sets or selections”, originated from Brazil. Customs positions of those goods under the MERCOSUR Common Nomenclature (N.C.M. or Nomenclatura Común del MERCOSUR) are 6302.60.00, 6302.91.00, 6302.93.00, 6302.99.10 y 6302.99.90.

Resolution No. 238/2010 of the Secretariat of Industry and Trade, published on December 15 in the Official Gazzete was announced in connection with the investigation initiated by Argentinean firm Ledesma S.A. due to the alleged dumping in exports to Argentina of “Paper and cardboard coated in one or the two faces with kaolin or other inorganic substances”, originated from the above-mentioned countries. Customs positions of those goods under the MERCOSUR Common Nomenclature (N.C.M. or Nomenclatura Común del MERCOSUR) are 4810.13.89, 4810.13.90, 4810.19.89 and 4810.19.90.

Resolution No. 241/2010 of the Secretariat of Industry and Trade, published on December 16 in the Official Gazzete (hereinafter jointly with Resolutions No. 238/2010 and No. 234/2010, the “Resolutions”) was announced in connection with the investigation initiated by firm Saint Gobain Isover Argentina S. A. due to the alleged dumping in exports to Argentina of “heat-strengthened phenolic resins spun glass, with or without covering”, originated from Mexico. The Customs position of those goods under the MERCOSUR Common Nomenclature (N.C.M. or Nomenclatura Común del MERCOSUR) is 7019.39.00.

Interested parties evidencing their condition may request questionnaires in order to participate in the investigation and access to the relevant file at the Secretariat of Industry and Trade. Likewise, they may provide evidence up to a maximum of ten (10) business days as from the notice of the preliminary findings.
